3.1 Eligibility

To use Ebonash, you must be at least 13 years old, in compliance with the Children’s Online Privacy Protection Act (COPPA) and similar regulations. By accessing or registering for the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, we recommend reviewing these Terms with a parent or guardian. Users under 13 are strictly prohibited from using the Service, and we reserve the right to terminate accounts found to violate this policy.

3.2 Account Responsibility

You are solely responsible for safeguarding your account credentials, including your email address and password. This includes not sharing your login details with others and using a strong, unique password. If you suspect unauthorized access, such as unexpected activity or login attempts, notify us immediately at Ebonash.Help. We are not liable for any losses or damages resulting from your failure to secure your account, but we will assist in recovering access where possible.

Additionally, you agree to provide accurate and up-to-date information during registration. Misrepresenting your identity or using someone else’s credentials may result in account suspension or termination.

3.3 Usage Rights

Images generated by Ebonash are yours to use freely for personal or commercial purposes—such as YouTube thumbnails, blog headers, or marketing materials—without the need for attribution. These images are created to be copyright-free, meaning you won’t face legal claims for using them in your projects. However, you may not resell, sublicense, or redistribute the Service itself (e.g., offering Ebonash-generated images as a standalone product) or claim ownership of the AI technology powering the platform.

For Ebonash 1.2, you may upload images to serve as the basis for thumbnail generation. You represent and warrant that any uploaded images are either your original work or you have the necessary rights or permissions to use them. Uploaded images are stored securely in our cloud infrastructure (AWS S3) and used solely for generating your thumbnails. We retain no ownership over uploaded images, but you grant Ebonash a non-exclusive, royalty-free license to process these images for thumbnail generation and to use your inputs (e.g., titles, customization settings, uploaded images) for improving our AI algorithms and showcasing anonymized examples of our capabilities in promotional materials.

3.4 Prohibited Conduct

To maintain a respectful and lawful community, you agree not to engage in the following activities:

• Use the Service to generate or upload illegal, offensive, or harmful content, including but not limited to thumbnails or images promoting hate speech, violence, pornography, or copyright-infringing material.
• Upload images for Ebonash 1.2 that you do not have the rights to use, such as copyrighted images or images containing third-party trademarks without permission.
• Attempt to reverse-engineer, hack, or disrupt the Service, such as bypassing credit requirements, accessing our source code, or launching denial-of-service attacks.
• Share generated or uploaded images in a manner that violates third-party rights, such as using someone else’s trademarked logo or copyrighted material without permission or misrepresenting the image’s origin.
• Create multiple accounts to exploit promotions, circumvent bans, or artificially inflate usage metrics.
• Use automated tools (e.g., bots, scrapers) to interact with the Service without our explicit written consent.

Violations may result in immediate account suspension, forfeiture of credits, and potential legal action if warranted. We reserve the right to review generated content and uploaded images to ensure compliance with these Terms.

3.5 Credits and Payments

Generating thumbnails requires credits, with each image costing 4 credits. You can purchase credits via the Pricing page using secure third-party payment processors (e.g., Razorpay, Stripe, PayPal). Credits are non-refundable and do not expire as long as your account remains active, giving you flexibility to use them at your convenience. We do not store your payment details directly; all transactions are encrypted and handled by our trusted partners.

Refunds are not offered for purchased credits, except in cases of payment errors (e.g., double charges) or at our sole discretion. If you encounter billing issues, contact us within 30 days of the transaction at Ebonash.Help with your receipt and a detailed explanation. Prices are subject to change, but existing credits retain their value unless otherwise stated.

3.6 Intellectual Property

The Ebonash platform—including its website design, AI technology, algorithms, logos, and branding—is the exclusive property of Ebonash and is protected by international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, but you may not copy, modify, or distribute any part of the platform without our prior written consent.

Generated images belong to you for unrestricted use, as they are unique outputs created by the AI based on your inputs and, for Ebonash 1.2, your uploaded images. We retain no ownership over these images beyond the limited license mentioned in Section 3.3. If you believe your intellectual property rights have been infringed by another user’s content or uploaded images on Ebonash, please notify us with specifics for investigation.

3.7 Limitation of Liability

Ebonash is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We strive to ensure the Service is reliable, but we do not guarantee uninterrupted access, error-free operation, or specific results from generated thumbnails or uploaded images. To the fullest extent permitted by law, Ebonash and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, such as loss of data, revenue, or reputation.

For example, if a thumbnail fails to generate correctly, an uploaded image is not processed as expected, or a server outage prevents access, our liability is limited to the cost of unused credits affected by the issue. You assume all risks associated with using the Service, including compatibility with your devices or reliance on generated content for commercial purposes.

3.8 Termination

We reserve the right to suspend or terminate your access to Ebonash at our discretion, with or without notice, if you violate these Terms or engage in conduct that harms the Service, other users, or our reputation. Examples include generating or uploading prohibited content, attempting to exploit the system, or failing to comply with payment obligations. Upon termination for cause (e.g., abuse), unused credits may be forfeited without refund.

You may also terminate your account voluntarily by contacting us or using the account deletion option (if available). In such cases, unused credits remain valid for 30 days post-request, after which they expire. We may retain certain data, including uploaded images, as required by law or for record-keeping purposes following termination.

3.9 Changes to Terms

We may modify these Terms at any time to reflect updates to the Service, legal requirements, or operational changes. When updates occur, we’ll post the revised Terms on this page with an updated "Last Updated" date. For significant changes (e.g., those affecting your rights or obligations), we may also notify you via email or a site banner.
